FRESH PRODUCTS INCLUDING ALL FLOWERS AND PETALS ARE GUARANTEED ONLY AS TO THE MERITS OF APPEARANCE. 3. SELLER WILL HAVE NO LIABILITY WITH RESPECT TO UNTIMELY ARRIVAL AND/OR DAMAGES DURING SHIPPING WHICH ARE THE RESULT OF THIRD PARTY CARRIERS. SELLER DOES AGREE TO SHIP ON A TIMELY BASIS FOR ARRIVAL ON OR BEFORE AGREED UPON DATE. 4. PRODUCTS ARE NOT TO BE EATEN OR CONSUMED AS PART OF BEVERAGES OR OTHERWISE. SELLER SHALL HAVE NO LIABILITY FOR STAINING OR DAMAGE TO FACILITIES, FABRIC, OR PERSONAL PROPERTY RESULTING FROM ANY USE OF THE PRODUCTS. DISCLAIMER AND LIMITATION OF WARRANTY AND LIABILITY. SELLER EXPRESSLY DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR QUALITY EXCEPT AS EXPRESSLY SET FORTH HEREINABOVE.
